$750,000 Settlement For Client Struck By Tractor Trailer

It was a mid-winter day. Our client, a 46-year-old woman who was a passenger in the Toyota (pictured above), was on I-96 on her way to work. Suddenly, a speeding truck’s large, refrigerated trailer swung into the left lane, striking the vehicle and causing damage and injuries. It could happen to anyone. Complicated Case
It was a complicated case. The defense retained a neurosurgery expert who shared his opinion that “[t]here is no evidence that the accident caused any new anatomic or compressive pathology in the spinal cord.” They also retained a mechanical engineer who felt the tractor-trailer alleged to be involved in the January 9, 2014 crash had not actually contacted our client’s vehicle. A police investigation also determined the tractor-trailer was not involved in the crash.
But, we did some serious digging and forced the defendant to produce internal investigative documents that indicated the defendant’s trailer did in fact leave its lane, enter our client’s lane and strike her vehicle, causing the collision; and that after this collision, our client demonstrated clinical findings of spinal cord compression that could not have existed before the crash, proving our client sustained significant spinal cord injury due to the defendant’s negligence.
